By accessing or using EverStory (the "Service") at everstory.digital or any related mobile application, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Ethics Charter, all of which are incorporated by reference.
These Terms apply to all users, including visitors, waitlist members, registered users, paid subscribers, and contributors invited to a story by another user.
If you are using EverStory on behalf of an organization (such as a congregation, school, or institution), you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

You must provide accurate, current, and complete information when creating your account. You are responsible for keeping your account information up to date.
You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to:
EverStory is not liable for any loss or damage arising from your failure to protect your account credentials.
Each individual may maintain one personal account. Organizations may maintain one organizational account. Creating multiple accounts to circumvent restrictions or limitations is prohibited.
You are solely responsible for all content you submit, post, or share through EverStory. By submitting content, you represent and warrant that:
EverStory is designed for stories about real people, including people who are deceased. You are responsible for ensuring that content about living individuals respects their dignity and, where appropriate, their consent. Content about deceased individuals should be submitted in good faith and with the genuine intention of honoring their memory.
To operate the Service — storing your stories, displaying them to authorized viewers, and enabling sharing — you grant EverStory a limited, non-exclusive, royalty-free, worldwide license to:
EverStory is designed for the legitimate preservation of personal and community stories. Permitted uses include creating stories for yourself, living or deceased family members, historical figures connected to your community, and organizational members with appropriate authorization.
You agree not to use EverStory to:
Content on EverStory must reflect genuine intent to honor, preserve, or document real lives and memories. We reserve the right to remove content that, in our reasonable judgment, is designed to harm, deceive, or exploit — and to suspend or terminate accounts responsible for such content.
EverStory offers a free plan and one or more paid subscription tiers ("Premium"). Current pricing, features, and billing terms for each plan are described on our Pricing page and may be updated from time to time with notice to you.
All payments are processed by Stripe, Inc., our third-party payment processor. By subscribing, you agree to Stripe's Terms of Service and Privacy Policy in addition to ours. EverStory does not store your full payment card details — Stripe handles all payment data under PCI-DSS Level 1 compliance standards.
We may change subscription prices. For existing subscribers, we will give at least 30 days' notice of any price increase before it affects your account. If you do not agree to the new price, you may cancel before the new price takes effect without penalty.
If a payment fails, we will notify you and attempt to retry the charge. If payment remains unsuccessful after a reasonable retry period, your account may be downgraded to the free plan. We will not delete your content due to payment failure — your stories remain yours.
If EverStory is ever discontinued, acquired, or materially changed in a way that affects your free plan, we commit to:
You have the right to export your data at any time, for any reason, at no additional cost. We provide:

Because EverStory is designed to outlast individual lifetimes, we provide tools for legacy management:

Your use of EverStory is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using EverStory, you consent to the collection and use of your information as described in the Privacy Policy.
Our privacy commitments are not just policies — they are promises enforced through our Ethics Charter. We will never sell your data, use it for advertising, or apply it in ways that conflict with the purpose for which you gave it to us.
EverStory integrates with certain third-party services to operate:
EverStory may contain links to third-party websites. These links are provided for convenience only. We have no control over third-party sites and are not responsible for their content, privacy practices, or terms. Visiting linked sites is at your own risk.
We do not endorse any third-party products, services, or content linked from EverStory unless explicitly stated.
The EverStory platform, including its design, code, branding, logos, features, and all content created by EverStory (as distinct from user content), is owned by Northwren Technologies and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from EverStory's proprietary materials without our written permission.
Your content remains your intellectual property in all circumstances. See Section 4 (Your Content & Ownership) and Section 5 (License You Grant Us).
If you submit ideas, suggestions, or feedback about EverStory, you grant us a perpetual, royalty-free license to use that feedback to improve the Service. We will not identify you publicly as the source of feedback without your permission.
We respect intellectual property rights. If you believe your copyrighted work has been used on EverStory without authorization, please send a DMCA notice to [email protected] including: identification of the copyrighted work; identification of the infringing material; your contact information; a statement of good faith belief; and your signature.
You may close your account at any time from your account settings or by contacting [email protected]. Before closing your account, we strongly recommend exporting your data (Section 9). Upon account closure:
We may suspend or terminate your account if we have reasonable grounds to believe you have violated these Terms, engaged in harmful or fraudulent conduct, or if required by law. In all but the most serious cases (imminent harm, illegal content), we will:
Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including Sections 4, 9, 13, 15, 16, 17, 18, and 19) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EVERSTORY DISCLAIMS ALL WARRANTIES, INCLUDING:
Nothing in this section limits consumer protection rights that cannot be excluded under applicable law. EU/UK consumers retain statutory rights that these disclaimers do not affect.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EVERSTORY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR:
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO EVERSTORY IN THE 12 MONTHS BEFORE THE CLAIM AROSE; OR (B) USD $100.
These limitations do not apply where prohibited by law. In particular, they do not apply to liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law under applicable consumer protection legislation in your jurisdiction.
You agree to defend, indemnify, and hold harmless EverStory and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of:
We reserve the right to assume control of any defense in which EverStory is named as a defendant, at our own cost. You agree to cooperate with our defense of such claims.
We'd like to resolve any dispute directly. Before filing any formal legal claim, you agree to contact us at [email protected] and allow us 30 days to attempt to resolve the matter informally. This does not limit your right to seek emergency relief where necessary.
For users based in the United States, any dispute not resolved informally will be settled by binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court. You waive the right to participate in a class action lawsuit or class-wide arbitration.
Exceptions to arbitration: Either party may pursue claims in small claims court for disputes within that court's jurisdiction. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
For EU/UK users, this choice of law does not deprive you of the protection of the mandatory provisions of the consumer protection laws of your country of residence.
For disputes subject to court jurisdiction (Section 18), you agree to submit to the exclusive jurisdiction of the courts located in Delaware, USA — except that EU/UK users may bring proceedings in their local courts as permitted by applicable law.
